§ 01 — Definitions

Definitions

• "Agreement" means these Terms and Conditions, as updated from time to time
• "We / Us / Our" means Pensara, operating from 74 Asok Montri Road, Watthana, Bangkok 10110, Thailand
• "You / User" means any individual or organisation accessing our website or purchasing our services
• "Services" means the Retirement Systems Reading Course, HR Workshop, Documentation Toolkit, and related educational products
• "Content" means all text, materials, printed goods, digital files, and guides produced or distributed by Pensara
• "Website" means the website operated at pensara.cyou

§ 02 — Acceptance of Terms

Agreement to These Terms

By submitting an enquiry form, completing a registration, or placing an order, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding agreement
• You have read and accept these Terms and Conditions and our Privacy Policy

§ 03 — Service Description

Our Services

Pensara provides educational materials on retirement and pension systems. Services currently offered are:

• Retirement Systems Reading Course (฿3,500 per individual)
• Retirement Planning Workshop for HR Teams (฿18,000 per session)
• Pension Documentation Organisation Toolkit (฿28,500 per kit)

Services are available to individuals and organisations based in Thailand. Delivery of physical products outside Bangkok is subject to logistics availability. Workshop delivery outside Bangkok is subject to scheduling agreement.

§ 04 — User Responsibilities

Your Obligations

When using our website or services, you agree to:

• Provide accurate information when enquiring, registering, or placing an order
• Use the Content for personal or internal organisational purposes only
• Not reproduce, share, sell, or distribute Content to third parties without written consent from Pensara
• Not use the website in any way that is unlawful or that disrupts access for other users
• Not misrepresent the scope or conclusions of our educational materials

§ 05 — Intellectual Property

Ownership of Content

All Content produced and distributed by Pensara — including course modules, workshop materials, printed guides, folder systems, and website text — is the intellectual property of Pensara and is protected under applicable Thai intellectual property law.

Upon purchase, you receive a non-exclusive, non-transferable licence to use the Content for your own personal or internal organisational purposes. You may not copy, adapt, republish, or distribute Content without prior written permission from Pensara.

§ 06 — Payment

Pricing and Payment

All prices are stated in Thai Baht (฿) and are inclusive of VAT where applicable. Payment must be received before course access is granted, workshop attendance is confirmed, or toolkit shipment is arranged.

Refund Policy

• Reading Course: Cancellation requests received within 7 days of payment and before first module access will receive a full refund. No refund after module access has been granted.
• HR Workshop: Cancellations made 14 or more days before the scheduled workshop date will receive a full refund. Cancellations within 14 days will receive a 50% refund. No refund for non-attendance.
• Documentation Toolkit: Returns accepted within 14 days of delivery if the physical kit is unopened and undamaged. Digital components are non-refundable once accessed.

§ 07 — Educational Scope

Educational Scope and Limitations

Pensara's services are educational in nature. All Content — including course modules, workshop sessions, and toolkit guides — provides general information about retirement and pension systems and documentation practices. Nothing in Pensara's services constitutes:

• Personal financial, investment, or retirement planning advice
• Legal advice on entitlement claims or disputes
• Tax advice of any kind

Participants are responsible for seeking qualified professional advice for their individual circumstances. Pensara does not warrant that any specific outcome will result from completion of its courses or use of its toolkits.

§ 08 — Disclaimers

Service Disclaimers

Content is provided as-is based on publicly available information at the time of writing. While we review material regularly, we do not warrant that all information is current at the time you access it. Pensara makes no representations about the completeness or accuracy of information for any specific personal situation.

Course access, workshop scheduling, and toolkit delivery are subject to availability. Pensara reserves the right to reschedule workshops with reasonable notice where circumstances require it.

§ 09 — Liability

Limitation of Liability

To the extent permitted by Thai law, Pensara's total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, or special damages of any kind.

Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, or for any other liability that cannot be excluded under applicable Thai law.

§ 10 — Termination

Termination of Access

Pensara reserves the right to restrict or terminate access to course materials or workshop participation if a user breaches these Terms. Refunds in such cases will be considered on their individual merits. You may cancel your enrolment at any time subject to the refund terms in Section 6.

§ 11 — Dispute Resolution

Governing Law and Disputes

These Terms are governed by the laws of the Kingdom of Thailand. In the event of a dispute, both parties agree to first attempt informal resolution by contacting us at [email protected]. If informal resolution is not achieved within 30 days, disputes shall be submitted to the competent courts in Bangkok, Thailand.

§ 12 — General Provisions

Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pensara
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force
• Waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in future
• Assignment: You may not assign rights under these Terms without our written consent; we may assign rights in connection with a business transfer

§ 13 — Changes to Terms

Updates to This Agreement

We may update these Terms from time to time. Updated terms will be posted to this page with a revised effective date. Continued use of our services following a material update constitutes acceptance of the new terms.
